An Argentine court has declared two goldfish, Fede and Magui, to be sentient beings with legal rights, marking a landmark moment for animal welfare in the country. The organization argued that keeping the two goldfish inside a small 40-liter display tank outside a sushi restaurant exposed them to direct sunlight, traffic noise, and constant disturbance from people tapping on the glass. Lawyer Matías Trufero said anyone who observed the aquarium could immediately recognize that the environment was unsuitable for the fish.

Aquatic specialists supported the complaint and compared the display tank to keeping polar bears inside a sauna (a sauna is a very hot room) , stressing that fish require carefully controlled living conditions. After reviewing the evidence, the court ordered the immediate relocation of Fede and Magui.They now live in a 2,500-liter aquarium at the home of aquatic specialist Carlos José Aga, who helped rescue the fish and now cares for them. The rescue was only one part of the legal victory. Jaulas Vacías also asked the court to recognize Fede and Magui as “subjects of law,” officially acknowledging them as sentient beings with legal rights. The court accepted that request, meaning the fish can now be regarded as victims in cases of cruelty instead of being treated solely as property. According to Matías Trufero, this legal status reinforces the principle that animals capable of experiencing suffering deserve meaningful protection under the law.

The ruling also builds on Argentina’s evolving approach to animal rights. In 2014, an Argentine court recognized Sandra, an orangutan at the Buenos Aires Zoo, as a non-human person, a decision that eventually led to her relocation to the Center for Great Apes in Florida. Animal welfare experts believe the latest judgment extends similar legal principles to fish and other animals commonly kept in homes and businesses. Carlos José Aga said legal recognition is only effective when people are willing to defend animals’ rights and ensure those protections are enforced, making this decision an important milestone for future animal welfare cases.
