Instagram and Facebook Face Changes If Meta Loses US Trial

Meta is facing a landmark federal trial over alleged harm to young users. The case stems from a 2023 lawsuit filed by 30 U.S. states, including California and New York. The states accuse Meta of violating federal and state laws protecting children online. They also allege that Meta designed features that encouraged young users to spend more time on its platforms.

Meta has strongly denied the allegations and says it has a longstanding commitment to protecting young people. Opening arguments are scheduled for August 18 in Oakland, California. The trial is expected to last about six weeks, with California, Colorado, Kentucky and New Jersey leading the case at trial. If the states win, the court could order changes to Infinite Scroll, Likes, Autoplay and Recommendation Algorithms, making the final ruling a major test of social media regulation and youth protection.

Meta Could Face Sweeping Instagram and Facebook Changes

The states are seeking major changes to Instagram and Facebook, particularly for young users. Their demands include ending public Like Counts and Infinite Scroll, while also changing recommendation systems that drive engagement. They want stronger age checks and Parental Verification for teenage users. In addition, the states are challenging Autoplay Videos, certain Image Filters, Multiple Accounts and disappearing content such as Instagram Stories. They argue that these features can encourage children to spend more time online. The states also accuse Meta of improperly collecting children’s data, bringing Youth Safety, Privacy and Platform Design together in the case.

Meta rejects those claims and points to safety tools already available on its platforms. However, the case could have consequences far beyond individual features. If the states prevail, a court order could force Meta to redesign parts of Instagram and Facebook for young users across the United States.

Meta Faces Billions in Potential Damages as Trial Tests Its Platform Design

The case carries major financial and legal risks for Meta. State lawyers are seeking about $193 billion in damages, a figure that some reports have rounded to nearly $200 billion. Meanwhile, Meta has warned that potential exposure could reach $1.4 trillion. However, that figure is Meta’s estimate, not the states’ demand. The states allege that Meta knew about mental health risks to young users and are using internal company research to support their claims. The case also challenges the recommendation algorithms and engagement features that drive Instagram and Facebook.

The trial follows other youth-safety setbacks for Meta. In New Mexico, a jury awarded $375 million in civil penalties, followed by another $567 million court order, taking the potential total above $942 million. Meta has said it will appeal. Separately, a Los Angeles jury found Meta and YouTube liable in March and awarded $6 million over a young user’s alleged social media addiction. Judge Yvonne Gonzalez Rogers now oversees the federal trial, with an eight-member advisory jury selected. The final ruling will determine whether the case results in financial penalties, platform-wide changes, or both.
